Taxation Appeal / Ruling

  1. 1 Whether the taxation proceedings were conducted with intent to render the application challenging the order awarding costs nugatory, thereby occasioning a miscarriage of justice.
  2. 2 Whether the taxation proceedings were conducted ex-parte without notice to the appellant, contrary to Regulation 50 of the Advocates (Remuneration and Taxation of Costs) Regulations.
  3. 3 Whether the taxed costs were manifestly excessive contrary to the principles of taxation.

Ratio Decidendi

The court found that the taxation proceedings were conducted irregularly, in disregard of pending substantive applications and without proper notice to the applicant, contrary to Regulation 50 of the Advocates (Remuneration and Taxation of Costs) Regulations. The court determined that the procedure adopted by the Deputy Registrar was irregular and amounted to an abuse of court process. As a result, the entire taxation was a nullity, having been conducted without following due process of law. The court set aside the taxation proceedings and awarded costs to the applicant.
