The trial judge erred by finding that the appellants had committed the offence at the stage of ruling on whether they had a case to answer, rather than merely determining if a prima facie case existed. This was a misapplication of Section 71(2) of the Trial on Indictments Decree, which the Court found to be misleading and bad law. The correct procedure is for the judge to decide only if there is sufficient evidence to require the accused to make a defence, not to make a finding of guilt before hearing the defence.
