Nkolo died intestate and childless, so the Plaintiff, as the only surviving daughter, became the residuary legatee and the most appropriate person to administer the estate. The Defendant, a nephew and administrator of Nkolo's estate, was only entitled to 1% of the estate as customary heir and any property the daughters chose to give him.
