Ratio Decidendi

The court found that the Applicants were not served with a hearing notice and the matter was not cause listed, which constituted sufficient cause for their absence when the suit was dismissed for want of prosecution. The court acknowledged the disruptions caused by the Covid-19 pandemic and judicial transfers, which further contributed to the Applicants' inability to attend. The court held that the Applicants had demonstrated sufficient cause as required under Order 9 rule 18 of the Civil Procedure Rules.
