The Supreme Court found that the delay in filing the notice of appeal in the Supreme Court was attributable to the Registrar of the Court of Appeal, who failed to transmit the notice as required by rule 73, and to the delayed determination of an application for correction of judgment in the Court of Appeal. These factors constituted sufficient reason for extension of time under rule 5. The applicants had complied with rule 72 by lodging the notice of appeal in the Court of Appeal.
