[2013] UGHCCRD 4
The High Court is mandated by Article 23(6)(c) of the Constitution to grant bail to any person remanded for 180 days without committal for trial. However, the court retains discretion over the terms of bail, including the evaluation of the sufficiency and substantiality of sureties as required by sections 14(1) and 17 of the Trial on Indictment Act. In this case, the applicants met the statutory threshold for mandatory bail, and the sureties presented were found to be of sufficient social standing and means. The court therefore granted bail, setting reasonable cash and non-cash bond amounts and imposing reporting requirements to ensure compliance and attendance at trial.

Legal Issues
- 1 Whether the applicants are entitled to mandatory bail after 180 days on remand without committal for trial.
- 2 What conditions and terms should be attached to the grant of bail, particularly regarding the sufficiency of sureties.
