Ratio Decidendi

The court found that the Applicant was properly served with summons and instructed Kajeke, Maguru & Co. Advocates to file a defence on his behalf, thereby binding himself to the admissions in the Written Statement of Defence. The Applicant was named and signed as a borrower in the financing agreement, and his claims of not being a borrower or of fraudulent procurement of his signature were unsustainable. The Applicant's affidavit was found to contain deliberate falsehoods and inconsistencies, which undermined the credibility of the Application. As a result, the affidavit was struck out, leaving the Application unsupported by evidence. The Application was therefore dismissed with costs.
