The burden of proof rested on the applicants to establish the existence of the caveats. Mere allegations without documentary proof were insufficient. Consequently, the court held that the applicants had not satisfied the evidentiary threshold required to warrant an order for removal of the caveats under Section 140(1) of the Registration of Titles Act.
