  1. 1 Whether the pleadings in Application No. 046/2020 should be reopened to allow further submissions by the Applicants.
  2. 2 Whether RFK and IHRDA should be granted leave to act as amici curiae in the Application.

Ratio Decidendi

The Court exercised its discretionary power under Rule 46(3) and Rule 90 of the Rules of Court, finding that the complexity and potential broader impact of the electoral issues raised justified reopening the pleadings. The Court also recognized the expertise of RFK and IHRDA in electoral dispute litigation and deemed their participation as amici curiae beneficial to the proper administration of justice. Accordingly, the Court granted the Applicants' request to file additional submissions and allowed RFK and IHRDA to act as amici curiae, ensuring that the Respondent State would have an opportunity to respond to the new submissions within 30 days.
