[2024] UGHCFD 65
The High Court of Uganda lacks original jurisdiction over matters already decided by the High Court of Kenya regarding the estate of Chandrakant Shamjibhau Gheewala, including the shares in Unique Holdings Ltd. The proper forum for contesting the inclusion of these shares in the estate is the Kenyan courts, not Uganda. The Ugandan court may only enforce foreign judgments under reciprocal arrangements, not re-adjudicate them. Since the matter is not properly before the Ugandan court, the issue of limitation does not arise. Accordingly, HCCS No. 416 of 2022 is dismissed for want of jurisdiction, and the parties are directed to seek remedies in the appropriate Kenyan court.
