The Court of Appeal held that the High Court's ruling on the application for extension of time was final, as it conclusively determined the fate of the election petition. The court found that both section 62 of the Parliamentary Elections Act and rule 6(1) of the Parliamentary Elections (Election Petitions) Rules impose a mandatory requirement to serve notice of presentation of the petition within seven days of filing. Rule 19 of the Rules does not empower the court to extend time fixed by statute.
