The absence of any repudiation or correspondence for over a year after the cheque was received supports this conclusion. The respondent was not required to plead estoppel because his defence was based on the existence of an agreement, not on estoppel, as there was no evidence that the respondent changed his position or suffered prejudice as a result of the appellant's conduct. The appeal was therefore dismissed.
