The court found that the last reply to the amended written statement of defence was filed on 29th April 2021. Under Order XIA Rule 1(2) of the Civil Procedure Rules (as amended), the plaintiff was required to take out summons for directions within 28 days thereafter. This was not done. The court rejected the plaintiff's argument that the rules did not apply, noting that the rules came into force on 31st May 2019 and the suit was filed on 12th August 2019, after the rules were already in effect.
