The majority of the Court of Appeal found that the appellant procured registration of the suit property in his name through fraud, contrary to the donor's instructions and interests. The evidence established that the late Samuel Muyizzi intended to donate the land to Bikaali Christian Fellowship, not to the appellant, and that the appellant misled his father and the advocates to effect a transfer in his own favour. The trial judge's findings on fraud and invalidity of the 2006 deed of donation were upheld.
