Ratio Decidendi

The court found that the applicants, as holders of a certificate of no objection and as plaintiffs in a pending civil suit, demonstrated sufficient grounds for the grant of letters of administration limited to the suit. The urgency and special circumstances, including the caveat on full administration and the need to preserve the deceased's interest in the litigation, justified the grant under section 222 of the Succession Act. The grant is strictly limited to representation in civil suit no.927 of 2019 and does not extend to distribution or management of the estate beyond the suit. The application was allowed to enable the applicants to proceed with the pending litigation.
