Additionally, the affidavit was deponed by the advocate acting both as counsel and witness in a contentious matter, contrary to professional conduct rules. Furthermore, the notice of motion was not properly signed or sealed by the Registrar as mandated by Order 5 rule 1(3) of the Civil Procedure Rules. Each of these grounds independently justified striking out the application, and collectively they rendered the application fatally defective and improperly before the court.
