The Court of Appeal found that the trial judge failed to adequately consider mitigating factors such as the appellant being a first offender, his age, remorsefulness, and time spent on remand. Although the offence was grave and warranted a deterrent sentence, the failure to balance aggravating and mitigating circumstances rendered the original sentence manifestly excessive. The appellate court exercised its power to resentence, determining that a 30-year imprisonment term from the date of conviction was appropriate to meet the ends of justice, taking into account both the seriousness of the offence and the mitigating factors.
