Ratio Decidendi

The Court found that the victim was sufficiently familiar with the appellant's voice to identify him as the perpetrator, even without prior direct conversation, in line with Supreme Court precedent. The sentence imposed by the trial Judge was deemed illegal because the period spent on remand was not properly deducted, as required by Article 23(8) of the Constitution and Supreme Court authority. Considering both aggravating and mitigating factors, and the sentencing range in similar cases, the Court substituted the sentence with 13 years' imprisonment, deducting the remand period to arrive at a final sentence of 11 years and 1 month to be served from the date of conviction.
