The Supreme Court held that as a second appellate court, its duty is not to re-evaluate evidence except in the clearest of cases. The only ground of appeal before the Court of Appeal was whether the sentence was harsh and excessive, and the Court of Appeal properly considered all mitigating and aggravating factors before upholding the sentence. The Supreme Court found no fault with the Court of Appeal's resolution and emphasized that new grounds of appeal cannot be raised at the Supreme Court if they were not considered by the lower courts. Accordingly, the appeal was dismissed as incompetent, and the sentence of 35 years imprisonment for each appellant was upheld.
