Ratio Decidendi

The court found that the application to substitute the 5th respondent with the commissioner for land registration was justified and would not prejudice the respondents, as the commissioner is the proper party. This amendment would enable the court to fully determine the real questions in controversy and avoid multiplicity of actions. However, the court declined to allow amendments to paragraphs 6, d, e, 8, 9, f and orders in f and h, as these would introduce a new cause of action (abandonment of trespass) and prejudice the respondents. The application was therefore partly allowed: leave was granted for substitution of the 5th respondent, but not for the other amendments.
