The proposed memorandum of appeal did not raise any triable issues. While negligence of counsel can sometimes constitute sufficient cause, in this case, the applicant's reliance on counsel's negligence was unsupported and appeared to be an afterthought intended to delay justice. The application was brought out of time without sufficient cause, and therefore, leave to appeal out of time was not warranted.
