Ratio Decidendi

The tribunal determined that although costs were awarded to the applicant following the preliminary objection, the intention was not for immediate taxation of the bill of costs. The principle that costs follow the event applies, but in interlocutory matters, costs should be assessed after the final determination of the main application. Taxing the bill of costs at this stage would be premature and could prejudge the outcome of the main suit. Both parties agreed that taxation should be deferred, and the tribunal found it prudent to stay the bill of costs until the main application is concluded. Each party is to bear its own costs for this application.
