The court found that, in the absence of misconduct, the respondent was entitled to terminal benefits as provided to other employees who left the bank without violation. The quantum of benefits was to be guided by the implemented retrenchment packages under the 1993 staff circular, including 12 months' salary and allowances, and a long service award on a pro rata basis, but excluding payment in lieu of notice.
