The application for security for costs was premised solely on the respondents' alleged lack of assets and income. The court held that poverty or lack of assets is not a valid ground for ordering security for costs, as it would unjustly bar access to justice for the poor and turn the court into an arena for only the rich. The court noted that the respondents' properties had already been mortgaged to the applicant as security for the loan at issue, and the applicant could not now claim the respondents had nothing. No sufficient grounds were established to justify the order sought. The application was dismissed with costs to the respondents.
