Procedural Posture

Miscellaneous Application / Ruling

  1. 1 Whether the Applicant is entitled to vacant possession of the mortgaged properties upon Respondents' default.
  2. 2 Whether the Respondents' failure to pay USD 1,000,000 as ordered by court entitles the Applicant to enforce its rights under the mortgage agreement.
  3. 3 Whether the Applicant followed the proper procedure in exercising its statutory power of sale under the mortgage.

Ratio Decidendi

The Respondents defaulted on their loan obligations and failed to comply with the court order to pay USD 1,000,000 within three weeks. The mortgage agreements expressly authorized the Applicant to enforce its statutory power of sale and seek vacant possession upon default, and the Applicant provided the required notices. The Respondents' admission of indebtedness and continued denial of access to the mortgaged properties constituted a breach of the agreed terms. The Applicant is therefore entitled to vacant possession of the properties to recover the outstanding debt.
