The court found that the affidavit of service did not sufficiently disclose the particulars of who was served, making it doubtful whether the appellant was properly notified of the hearing date. The technical irregularity in service, combined with the constitutional right to be heard under Article 28, rendered the proceedings a miscarriage of justice. The Labour Officer should not have proceeded exparte without clear evidence that the appellant was served for the actual hearing date. The appeal was allowed and a retrial before another Labour Officer was ordered.
