The contract was further invalidated by non-fulfillment of its conditions by both parties. The alleged fraud did not reside in the registered proprietor (second defendant), but in other parties, and thus could not justify cancellation of the title. The plaintiff did not qualify as a bona fide occupant under the Land Act, 1998, as it had not occupied the land for twelve years prior to the 1995 Constitution and its possession was based on an illegal contract....
