The post-dated cheque issued as security was not honoured due to insufficient funds, and repeated promises to pay were not fulfilled. The 2nd, 3rd, and 4th Defendants acted as directors but the loan was to the company, not to them personally. Applying the principle of corporate personality, only City Casino Limited is liable for the debt. The Plaintiff is entitled to recover the principal sum, contractual interest at 3% per month from the date of default, general damages for breach of contract, and costs.
