H}{\insrsid5532330\charrsid3286344 e submitted that all that the plaint averred was that the plaintiff had been on }{\insrsid10689236\charrsid3286344 the land for sometime.}{\insrsid5532330\charrsid3286344 }{ \insrsid10689236\charrsid3286344 H}{\insrsid5532330\charrsid3286344 e tried to get a land title but before he got one the defendants got one and thus blocking the plaintiff\rquote s chances of having the land surveyed and registered in his names hence the institution of the }{\insrsid10689236\charrsid3286344 instant case. H}{\insrsid5532330\charrsid3286344 e }{\insrsid10689236\charrsid3286344 contended there was}{ \insrsid5532330\charrsid3286344 no cause of action. }{\insrsid10689236\charrsid3286344 If}{\insrsid5532330\charrsid3286344 the learned counsel for the plaintiff had }{\insrsid10689236\charrsid3286344 alleged}{\insrsid5532330\charrsid3286344 the defendants got the titles }{\insrsid10689236\charrsid3286344 fraudulently}{\insrsid5532330\charrsid3286344 and had pleaded fraud the plaint should have disclosed a cause of action. I was referred to the case of }{\b\ul\insrsid5532330\charrsid3286344 Auto Garage vs M}{\b\ul\insrsid10689236\charrsid3286344 otokov (No.3) 1971 EA. P}{\b\ul\insrsid5532330\charrsid3286344 . 51 }{\insrsid5532330\charrsid3286344 where it was held that plaint disclosed no cause of action and as such it }{ \insrsid10689236\charrsid3286344 w}{\insrsid5532330\charrsid3286344 as incurable by amendment. He continued the failure by the plaintiff to plead fraud went to the heart of the whole action and referred me to another case of }{ \b\ul\insrsid5532330\charrsid3286344 James Birikwate vs Kilembe Nines Ltd 1976 }{\b\ul\insrsid10689236\charrsid3286344 (HCB)}{\b\ul\insrsid5532330\charrsid3286344 18}{\ul\insrsid5532330\charrsid3286344 }{\insrsid10689236\charrsid3286344 w}{ \insrsid5532330\charrsid3286344 here it was held that where the cause of action is missing altogether in the plaint the defect cannot be cured by amendment and that under }{\insrsid10689236\charrsid3286344 order 7 rule 11 of}{ \insrsid5532330\charrsid3286344 the }{\insrsid10689236\charrsid3286344 Civil Procedure Rules it i}{\insrsid5532330\charrsid3286344 s mandatory upon t}{\insrsid10689236\charrsid3286344 h}{\insrsid5532330\charrsid3286344 e }{ \insrsid10689236\charrsid3286344 court to reject a plaint which does not disclose a cause of action. He prayed that the plaint be rejected with cos}{\insrsid5532330\charrsid3286344 t}{\insrsid10689236\charrsid3286344 s}{\insrsid5532330\charrsid3286344 under order }{\i\insrsid5532330\charrsid3286344 7 }{\insrsid10689236\charrsid3286344 rule 11 of the Civil}{\insrsid5532330\charrsid3286344 }{\insrsid10689236\charrsid3286344 Procedure rules. \par On the other hand the learned counsel ap}{\insrsid5532330\charrsid3286344 pearing }{\insrsid5532330\charrsid3286344 for}{\b\i\insrsid5532330\charrsid3286344 }{\insrsid5532330\charrsid3286344 the plaintiff submitted }{\insrsid10689236\charrsid3286344 that }{\insrsid5532330\charrsid3286344 the objection should be overruled because the cause of }{\insrsid5772382\charrsid3286344 action is shown}{\insrsid5532330\charrsid3286344 in the plaint and wo}{\insrsid5772382\charrsid3286344 u ld be expanded upon the evidenc}{\insrsid5532330\charrsid3286344 e in the course or the }{\insrsid5772382\charrsid3286344 proceedings}{\insrsid5532330\charrsid3286344 and }{\insrsid5772382\charrsid3286344 would}{\insrsid5532330\charrsid3286344 further be argued upon }{\insrsid5772382\charrsid3286344 whe}{\insrsid5532330\charrsid3286344 n this court receives the annextu}{\insrsid5772382\charrsid3286344 res which are attached to the plaint. On the face}{\insrsid5532330\charrsid3286344 of it the }{\insrsid5772382\charrsid3286344 plaintiff enjoyed the right in that he}{\insrsid5532330\charrsid3286344 has been in }{\insrsid5772382\charrsid3286344 the}{\insrsid5532330\charrsid3286344 }{\insrsid5772382\charrsid3286344 occupa tion of the suit pieces of land. He had an offer of that p}{\insrsid5532330\charrsid3286344 iece of }{\insrsid5772382\charrsid3286344 lan}{\insrsid5532330\charrsid3286344 d }{\insrsid5772382\charrsid3286344 and instructions to survey had been given to him. H}{\insrsid5532330\charrsid3286344 e had }{\insrsid5772382\charrsid3286344 had th}{\insrsid5532330\charrsid3286344 e piece of land }{\insrsid5772382\charrsid3286344 surveyed}{ \insrsid5532330\charrsid3286344 and then out of the blue the defendants }{\insrsid5772382\charrsid3286344 had}{\insrsid5532330\charrsid3286344 that }{\insrsid5772382\charrsid3286344 piece}{\insrsid5532330\charrsid3286344 of land }{ \insrsid5772382\charrsid3286344 surveyed}{\insrsid5532330\charrsid3286344 into their names and had }{\insrsid5772382\charrsid3286344 the certificate of title granted to them. The case}{\insrsid5532330\charrsid3286344 for the plain}{ \insrsid5772382\charrsid3286344 tiff is that his right had been}{\insrsid5532330\charrsid3286344 violated. The land having been offered to him earlier and having had it surveyed earlier he was seeking relief from this court to vindicate and declare that the latter claim of offer of su}{\insrsid5772382\charrsid3286344 rvey and ultimately the issue of }{\insrsid5532330\charrsid3286344 titles subordinated upon his earlier }{\insrsid5772382\charrsid3286344 right. That constituted a}{\insrsid5532330\charrsid3286344 cause o}{\insrsid5772382\charrsid3286344 f action in this matter. The cases quoted by his learned brother are}{\insrsid5532330\charrsid3286344 }{\insrsid5772382\charrsid3286344 distinguishable}{\insrsid5532330\charrsid3286344 from the present ca}{\insrsid5772382\charrsid3286344 se because in the instant case there was a case of action whereas }{\insrsid5532330\charrsid3286344 in the others no cause of action }{\insrsid5772382\charrsid3286344 existed}{\insrsid5532330\charrsid3286344 . He }{\insrsid5772382\charrsid3286344 p}{ \insrsid5532330\charrsid3286344 rayed that the objections be rejected }{\insrsid5772382\charrsid3286344 with costs. \par In reply Mr. M}{\insrsid5532330\charrsid3286344 usan}{\insrsid5772382\charrsid3286344 a}{\insrsid5532330\charrsid3286344 submitted that the court must look at the }{\insrsid5772382\charrsid3286344 plaint an}{\insrsid10174616\charrsid3286344 d nothing}{ \insrsid5532330\charrsid3286344 else. It is not enough just to allege by the plaintiff }{\insrsid10174616\charrsid3286344 that}{\insrsid5532330\charrsid3286344 he tried to get title of the land earlier and the defendant got title before him. In addition }{\i\insrsid11225729\charrsid3286344 of course the plaintiff must ap}{\i\insrsid5532330\charrsid3286344 pear as a person aggrieved by }{\i\insrsid11225729\charrsid3286344 the}{\i\insrsid5532330\charrsid3286344 }{\i\insrsid11225729\charrsid3286344 violation}{\i\insrsid5532330\charrsid3286344 of his right}{\i\insrsid11225729\charrsid3286344 and the defendant as a person who}{\i\insrsid5532330\charrsid3286344 is liable, then in my opinion a }{\i\insrsid11225729\charrsid3286344 cause of ac}{\i\insrsid5532330\charrsid3286344 tio}{\i\insrsid5465128\charrsid3286344 n has been disclosed and any omission}{\i\insrsid5532330\charrsid3286344 o}{\i\insrsid5465128\charrsid3286344 r defect may be put right by amendmen}{\i\insrsid5532330\charrsid3286344 t.
