They failed to conduct due diligence to ascertain the existence of the road reserve, and constructive notice is imputed to them. The permission granted by the municipal authorities was for construction along, not within, the road reserve. The demolition notice, though initially defective under the Public Health Act, was ultimately consistent with the enforcement provisions of the Physical Planning Act, 2010, and the plaintiffs did not appeal the enforcement notice.
