  2. 2 Whether a document tendered for identification but not admitted as an exhibit can be relied upon as evidence.
  3. 3 Whether the appellate judge properly directed himself on the law relating to the standard of proof in civil cases.

Ratio Decidendi

The Court of Appeal held that the High Court, as the first appellate court, properly reevaluated the evidence and was justified in differing from the trial magistrate's findings. The evidence supported the respondent's claim of ownership by gift inter vivos from his mother, and the orders for declaration of ownership and injunction were properly granted. However, the awards for general damages and mesne profits were set aside due to lack of evidential basis and justification. The appeal substantially failed except for the variation regarding damages and mesne profits, and the appellant was ordered to pay three-quarters of the taxed costs.

Court Disposition

appeal dismissed with variation

Orders

  • Awards for general damages and mesne profits are set aside.
  • Declaration that the suit land belongs to the respondent is upheld.
