The trial Magistrate erred in dismissing Civil Suit No.047 of 2021 for being res-judicata because the requirements under Section 7 CPA were not met. The parties in the previous Local Council suit and the present suit were not the same, and the cause of action arose at different times. Furthermore, res-judicata was not pleaded by the respondent in the Magistrate's Court, as he did not file a defence. The dismissal amounted to a termination of the suit without a hearing on its merits, which is contrary to the object of Section 83(c) CPA that empowers the High Court to prevent failure of justice.
