The trial Judge failed to comply with Article 23(8) of the Constitution by not deducting the period the appellant spent on remand, rendering the sentence illegal. The appellate court set aside the sentence and, exercising its powers under Section 11 of the Judicature Act, imposed a new sentence after considering aggravating and mitigating factors and the sentencing range in similar cases. The appellant was sentenced to 19 years, 10 months, and 9 days' imprisonment, after deducting the remand period, to be served from the date of conviction.
