Ratio Decidendi

The court found that the first Defendant breached the indemnification agreement by failing to repay the embezzled funds, and the second Defendant, as guarantor, failed to fulfil his obligation upon default by the first Defendant. The Defendants did not contest the claims, and default judgment was entered for the liquidated sum of USD 19,451. The Plaintiff was also entitled to general damages, interest at 18% per annum from the date of filing until payment in full, and costs.
