Miscellaneous Application / Ruling

  1. 1 Whether the applicants have established grounds for review of the judgment in Civil Appeal No. 102 of 2016.
  2. 2 Whether the failure to allow introduction of new evidence (sale agreement) constitutes a sufficient reason for review.
  3. 3 Whether the applicants suffered a legal grievance justifying review.

Ratio Decidendi

The application for review was dismissed because the applicants failed to demonstrate that they suffered a legal grievance as required by law. The court found that the application was not in respect of the dismissal of HCMA 2 of 2020, and no appeal or review was preferred against that decision. The applicants did not adduce any agreement to prove ownership of the suit land at trial or on appeal, whereas the respondent did. The grounds advanced by the applicants were found to be more appropriate for an appeal rather than a review, and the applicants failed to meet the legal threshold for review under Section 82 of the Civil Procedure Act and Order 46 Rule 1 of the Civil Procedure Rules....
