Ratio Decidendi

The Plaintiff proved that a valid contract for the sale of 10 acres of land existed, consideration was paid, and the Defendant failed to perform his contractual obligations. The court found no plausible explanation for the Defendant's non-performance and held that the Plaintiff was entitled to recovery of the land, vesting of title, vacant possession, general damages, costs, and interest. The amount of general damages claimed was reduced to Shs.5,000,000/- as adequate compensation for inconvenience suffered. The Plaintiff is required to pay the outstanding balance of Shs.6,700,000/- to the Defendant for completion of the transaction.
