The court found that the trial Magistrate awarded costs without following the mandatory procedure for taxation as set out in the Advocates (Remuneration and Taxation of Costs) Regulations. No bill of costs was filed, no notice of taxation hearing was issued, and no proceedings of a taxation hearing were on record. The Magistrate exercised jurisdiction not vested in her by specifying the amount of costs without proper taxation. Although the appeal was brought under the wrong law, the court relied on the principle that wrong citation does not invalidate proceedings where jurisdiction exists.
