Ratio Decidendi

The court found that the dispute arises from agreements containing an arbitration clause, and the respondent's argument that a subsequent payment plan constituted a separate agreement was misconceived. The email proposing the payment plan did not amount to a binding contract independent of the original agreements. Therefore, the dispute falls within the scope of the arbitration clause and is governed by the Arbitration and Conciliation Act. Pursuant to Section 9 of the Act, the court lacks jurisdiction to entertain, hear, and determine the dispute in the summary suit. All other issues are rendered moot by this finding.
