The court found that the consent judgment entered into by the applicant and respondent was erroneous and illegal, as it purported to resolve the issue of the existence of a customary marriage without judicial determination. The judgment would have impliedly dissolved a marriage that was still in dispute, which is not permissible by law. The parties could not, by consent, authorize the celebration of a church marriage without first resolving the underlying marital status. The court held that only a judicial pronouncement could resolve the existence of a customary marriage, and that the consent judgment was therefore set aside.
