Miscellaneous Application / Application for Extension of Time to File Appeal

  1. 1 Whether the applicants have shown sufficient reason for extension of time to file an appeal out of time.
  2. 2 Whether the pendency of an incompetent appeal bars an application for extension of time.
  3. 3 Whether the faults of advocates and court should be visited on the applicants.

Ratio Decidendi

The Court of Appeal has wide discretion under Rule 4 to extend time for any act required by the rules if sufficient reason is shown. The applicants were not guilty of any dilatory conduct; the delay was caused by their former advocates and the court's delay in supplying the record of appeal. The faults of counsel and the court should not be visited on the applicants. The pendency of an incompetent appeal does not bar an application for extension of time. The application for extension of time to validate Civil Appeal No. 38/97 is granted as justice demands that disputes be decided on their merits and errors or lapses should not debar a vigilant litigant from pursuing their rights.
