Ratio Decidendi

The appeal was filed outside the statutory thirty-day period prescribed by Section 79(1) of the Civil Procedure Act, and the appellants did not obtain leave of court to file out of time. Their request for the record of proceedings was made several months after judgment, precluding reliance on the exception under Section 79(2). Furthermore, the notice of appeal does not commence an appeal in the High Court; only a memorandum of appeal does. As a result, the memorandum of appeal was incompetent and the appeal was struck out with costs to the respondent.
