Ratio Decidendi

The court found that the land comprised in Block 306-310 Plot 1894 does not constitute family land within the meaning of Section 38A of the Land Act, as neither party nor their family ordinarily resides or derives sustenance from it, nor was there evidence of a voluntary agreement to treat it as family land. The respondent failed to discharge the burden of proof required to establish the land as family land. Consequently, the caveat lodged by the respondent was not supported by a caveatable interest under the law, and the land was not subject to the requirement of spousal consent. The applicant was entitled to have the caveat removed and to be awarded costs.
