Ratio Decidendi

The Court of Appeal found that the Appellant was denied a fair hearing when the High Court proceeded with the hearing and delivered judgment in the Appellant's absence, following a public holiday, without issuing a fresh hearing notice. The right to a fair hearing is fundamental, and the Appellant was prejudiced by not being able to contest the survey report and the allocation of land. The procedural impropriety amounted to a mistrial, necessitating the setting aside of the High Court's judgment and decree. The Court ordered a retrial before a different Judge to ensure all issues, including the correct identification of the land parcel, are addressed afresh with both parties present.
