The court found that the proceedings at the locus-in-quo were irregular and contrary to established legal principles, as random witnesses who had not testified in court were called to give evidence. However, this irregularity did not render the entire trial a nullity because sufficient admissible evidence existed to determine ownership of the suit land. The Respondent proved, on a balance of probabilities, continuous occupation and use of the land since the 1950s, supported by oral testimony and documentary evidence.
