The High Court found that the trial Magistrate erred by failing to properly evaluate the evidence and by shifting the burden of proof to the Defendant/Appellant. The evidence established that the Appellant had lived on the suit property with his mother, constructed a house there, and continued to reside there after her death. The Respondent's claim of purchase was not sufficiently supported by the evidence, particularly as the sale agreement (PEX1) did not account for the presence of family graves or the Appellant's longstanding occupation.
