The court found that the alleged conflict of interest by Applicants' counsel was not substantiated, as the subject matter and parties in the previous and current suits were not the same, and the evidence did not show representation of the Respondent by the impugned advocate in matters touching the suit land. On limitation, the court held that the cause of action arose not at the date of the consent judgment (25th August 2010), but when the Respondent discovered the sale and transfer of the suit land to the Applicants, which occurred in 2017 and later.
