Ratio Decidendi

The Respondent terminated the 2nd Claimant's employment on grounds of restructuring and redundancy without complying with the mandatory procedures set out in the Employment Act and the Collective Bargaining Agreement. Specifically, the Respondent failed to provide the required notice to the employee, the union, and the Commissioner Labour, and did not pay the terminal benefits stipulated in the CBA. The evidence was uncontroverted as the Respondent did not appear or defend the claim. The court found that the termination was unlawful and that the Claimant was entitled to payment in lieu of notice, severance pay, repatriation allowance, general damages, a certificate of service, and costs....
