The court found that although the respondents' suit was filed outside the statutory limitation period under the Law Reform (Miscellaneous Provisions) Act, the applicant, with full knowledge of the limitation issue, chose to enter into a mediated settlement agreement that was endorsed by the court as a consent judgment. By doing so, the applicant acknowledged liability and waived its right to raise the limitation objection. The deed of settlement constituted a binding contract, and the applicant's subsequent attempt to rely on limitation to avoid its obligations under the settlement was an abuse of court process.
