The Supreme Court found that its jurisdiction to entertain appeals is limited to decisions of the Court of Appeal that have not already been appealed and confirmed by the Supreme Court. Since the decision in question had already been appealed and upheld by the Supreme Court, there was no longer a Court of Appeal decision to appeal against, rendering the application incompetent. While the applicant alleged illegality in the interest award, the court reaffirmed that only a full panel of justices, not a single justice, has jurisdiction to correct such alleged illegality in a final decision.
