Although the complainant was in possession of the kiosk and the respondents were present at the scene, the nature and extent of the damage to the kiosk was not proved to the required standard, and the evidence suggested that any demolition occurred months after the eviction and was carried out by the landlord. The eviction itself, though possibly justified by the complainant's conduct, was unlawful as it was not sanctioned by a court order.
